##Request Could you please provide me with current statistics of how many others have received a similar Fixed Penalty Notice as a result of bad advice from NHS staff The NHS Business Services Authority (NHSBSA) received your request on 29 July 2024. We have handled your request under the Freedom of Information Act (FOIA) 2000. ##Our response We do not hold the information you have requested. This is because we check what exemption has been claimed on the dental form and this is then checked with DWP who either confirm or not confirm if the patient has a valid exemption. If not confirmed, then the enquiry letter is issued. Our records do not contain information on whether a patient was misadvised. When claiming exemption from NHS dental costs, patients have a duty of care and are responsible for knowing whether they have to pay NHS charges. When claiming exemption a declaration is signed by the patient or their representative which states: “The patient is responsible for the accuracy of this claim, NOT the dental practice. If you’re not certain that you’re entitled to receive free or reduced cost NHS dental services you MUST pay the dental practice.”
