If you are not even able to provide me with the above information, then please provide me with the information from October to December 2012 for the applicants who applied for PIB (who applied after 6 months from the deadline according to the 1995 NHS Injuries Benefits scheme) and were considered by the NHSBSA.’ The NHS Business Services Authority (NHSBSA) received your requests on 27 October. We have handled your request under the Freedom of Information Act 2000 (FOIA). ##Our response As these requests pertain to the same information across different time periods, we have consolidated them into a single request under reference FOI-03306. We have considered this request under the Freedom of Information Act 2000 (FOIA) and are issuing a refusal notice under section 17 of the FOIA. The NHSBSA does hold the requested information; however, we estimate that the cost of compliance with the request would exceed the appropriate limit under section 12 of the FOIA. We estimate that the cost of complying with your request would exceed the non-central Government limit of £450. The limit has been specified in The Freedom of Information and Data Protection (Appropriate Limit and Fees) Regulations 2004 and represents the estimated cost of one person spending 18 hours in determining whether the NHSBSA holds the information, and locating, retrieving, extracting and checking the information. Due to the way in which historical Injury Benefits are recorded we are unable to identify the received date of an application without manual interrogation of the injury benefit record. Therefore, for all the questions above we would need to manually interrogate 26,876 cases. We estimate it would take 5 minutes to manually interrogate each case. Please see the following calculations which sets out the estimated cost for compliance with this request: 26,876 x 5 minutes = 134,380 minutes (2,239 hours) Please note, since your previous request, https://opendata.nhsbsa.net/dataset/foi-03218, we have determined that the number of cases is 26,876 and not 32,000 as previously disclosed. FOI-03218 has now been updated to reflect the accurate number of cases. Please be advised that due to the way that the information is held by the NHSBSA, it is not possible to submit a refined request under the appropriate limit.
