##Request ‘I would now like to request this information under the freedom of information act, where a response within the specified timescale would be appreciated. I understand that the implementation of the remedy is a complex and significant undertaking. However, a number of retired members remain in a position where their pension benefits have not yet been fully reviewed and adjusted. For those affected, this ongoing uncertainty is causing understandable concern, particularly where final pension entitlements and any associated arrears are still pending. I would therefore be grateful if you could provide: An indication of the current expected timescales for completing reviews for retired members as this is still unclear on your website; Clarification on whether cases are being prioritised in any particular order; Confirmation of how affected individuals will be contacted once their case has been processed; and Details of any interim steps retirees should take while awaiting recalculation. If there are known delays or revised implementation milestones, transparency around these would be very helpful for members planning their financial affairs, particularly as these dates keep changing and being put back.’ The NHS Business Services Authority (NHSBSA) received your request on 25 June 2026. We have handled your request under the Freedom of Information Act 2000 (FOIA). ##Our response __Question 1 - An indication of the current expected timescales for completing reviews for retired members as this is still unclear on your website__ There are two current expected timescales for retired members to receive their Remediable Service Statement (RSS), depending on how their benefits are currently being treated. Please note these timelines are subject to change in accordance with the ministerial statement issued on 13 July 2026 (https://hansard.parliament.uk/commons/2026-07-13/debates/26071346000008/NHSPensionSchemeMccloudRemedy): Timeline 1 (By the end of December 2027): This applies to retired members whose pension benefits are still actively affected by discrimination until they make their choice. It includes members currently receiving 2015 Scheme benefits for some or all of the remedy period. Timeline 2 (By the end of June 2030): This applies to retired members already receiving 1995/2008 Scheme benefits for all of their remediable service. This includes those whose pension was returned to the 1995/2008 Scheme on 1 October 2023 (where discrimination has already been addressed in their current payments but are due a choice to understand whether 2015 Scheme benefits may be more beneficial) and retired after this date. __Question 2 - Clarification on whether cases are being prioritised in any particular order__ Cases are being prioritised in a specific order based on how heavily a member's pension benefits are affected by the public service pension remedy. The NHS Pensions Service is using the following criteria to prioritise cases: By impact on benefits: Priority is given to members whose choice is more likely to change or affect their current pension benefits. Timeline 1 members: Members whose pension benefits are still actively affected by discrimination are placed in the first timeline (expected by December 2027). This includes retired members currently receiving 2015 Scheme benefits for the remedy period. Timeline 2 members: Members whose pension was already returned to the 1995/2008 Scheme on 1 October 2023 or who are already receiving 1995/2008 Scheme benefits for all of their remediable service, have a lower priority (expected by June 2030) because the discrimination has already been addressed in how their pension is currently being paid. Grouping by category and complexity: RSSs are sent out in phases using specific criteria so that members with similar circumstances are treated consistently and fairly. Exceptions for urgent priority: Members can request to make their choice sooner under specific urgent scenarios, such as having a life expectancy of less than 12 months, specific unsuccessful ill-health retirement applications, or meeting precise Scheme conditions regarding tapered protection. __Question 3 - Confirmation of how affected individuals will be contacted once their case has been processed__ We are working hard to dispatch all outstanding RSS. We will contact McCloud-affected members directly with their RSS once it has been calculated. Once we receive the member’s decision form, we will confirm their choice and final pension benefits in writing. __Question 4 - Details of any interim steps retirees should take while awaiting recalculation__ There is nothing else McCloud-affected members need to do right now. We will automatically write to affected members as soon as we have their RSS ready to dispatch.
